Welcome to Gigacatalyst. These Terms of Service (“Terms”) govern your use of our AI assistant product designed for builders (“Service”). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Gigacatalyst grants you a non-exclusive, non-transferable, revocable license to use the Service for your personal or business development needs. This license is subject to these Terms and any other agreements you may have with Gigacatalyst.
We respect your privacy and intellectual property rights. As detailed in our Privacy Policy:
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
You agree not to use the Service:
The Service and its original content, features, and functionality are and will remain the exclusive property of Gigacatalyst and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Gigacatalyst.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
New self-serve GTM Multiplier Agent customers are eligible for a refund of their first paid month's base subscription fee if the agent does not book a qualified meeting during the first 30 paid days of the subscription.
A qualified meeting is a meeting booked through a campaign run by GTM Multiplier Agent with a prospect matching one of the target profiles approved by the customer. To remain eligible, the customer must connect a supported outreach account, approve or provide an actionable lead set, and launch the recommended campaign within seven days of checkout. The account and campaign must remain available to run for at least 21 days during the guarantee period.
Refund requests must be sent to support@gigamind.dev within seven days after the first 30 paid days end. The guarantee covers the first month's base subscription fee only; taxes, usage charges, and additional-user fees are excluded. It does not apply to accounts suspended for misuse, legal or platform-policy violations, or customer-requested pauses that prevent the campaign from running.
In no event shall Gigacatalyst, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
